- Definitions
In these Terms & Conditions:
- “Company” means Starlight Party Hire
- “Customer” means the person, business, or entity hiring equipment
- “Equipment” means all items hired including marquees, furniture, accessories, and ancillary goods
- “Hire Period” means the agreed time the equipment is in the customer’s possession or control
- Australian Consumer Law
Nothing in these Terms & Conditions excludes, restricts, or modifies any rights or remedies the Customer may have under the Australian Consumer Law (ACL). Where liability cannot be excluded, it is limited to the maximum extent permitted by law.
- Quotes & Formation of Contract
3.1 Quotes, proposals, or estimates do not constitute a reservation of equipment.
3.2 Equipment is only reserved upon receipt of the required deposit and written confirmation from Starlight Party Hire.
3.3 Starlight Party Hire reserves the right to decline any booking request at its discretion prior to acceptance.
- Deposits & Booking Confirmation
4.1 A 25% non-refundable deposit is required to secure all bookings.
4.2 Bookings exceeding $2,000 require a 50% non-refundable deposit.
4.3 The deposit confirms reservation of equipment for the agreed hire period.
4.4 If the deposit is not received, the Starlight Party Hire is not obliged to hold equipment.
- Payment Terms
5.1 Full payment must be received no later than 7 days prior to the event date.
5.2 Failure to pay by this deadline may result in cancellation without refund of any deposit.
5.3 Starlight Party Hire is not obliged to deliver or release equipment until full payment has cleared.
- Cancellation & Credit Policy
6.1 All deposits are strictly non-refundable.
6.2 If the Customer cancels:
- the deposit is forfeited; and
- any additional payments may be forfeited depending on costs incurred
6.3 Cancellations within 7 days of the event are not eligible for a refund.
6.4 Any credit issued is at the sole discretion of Starlight Party Hire and valid for 12 months.
- Delivery, Access & On-Site Authority
7.1 The Customer must ensure safe, clear, and unobstructed access to the site.
7.2 Starlight Party Hire may refuse delivery or installation if access is unsafe, restricted, or unsuitable.
7.3 Starlight Party Hire’s delivery team has final authority on site regarding safety, access, and setup feasibility.
7.4 Additional charges may apply for delays, difficult access, or site restrictions.
- Site Suitability & Space Requirements
8.1 The Customer is solely responsible for ensuring the site is suitable and has adequate space.
8.2 All measurements provided by Starlight Party Hire are indicative only.
8.3 The customer must ensure:
- correct equipment footprint
- sufficient clearance for installation, anchoring, and safe use
- level and safe ground conditions
8.4 If the site is unsuitable at time of delivery:
- Starlight Party Hire may reduce, modify, or refuse installation
- No refund is payable
- Any credit is at Starlight Party Hire’s sole discretion
- Marquee Use & Limitations
9.1 Marquees are designed for temporary shelter from sun and light rain only.
9.2 Marquees are not designed for strong winds, storms, or extreme weather.
9.3 The Customer acknowledges outdoor events are inherently weather dependent.
9.4 No warranty or guarantee is given regarding weather suitability.
- Weather, Force Majeure & Event Disruption
10.1 Starlight Party Hire is not responsible for weather related conditions including wind, rain, storms, flooding, or natural disasters.
10.2 Starlight Party Hire is not liable for delays or failure caused by force majeure events including (but not limited to):
- extreme weather
- government restrictions
- transport disruptions
- supplier failure
10.3 No refunds or credits are provided due to weather or force majeure events.
10.4 The customer remains fully responsible for equipment during adverse conditions.
- Insurance & Risk Disclaimer
11.1 All equipment is supplied without insurance coverage by Starlight Party Hire.
11.2 The customer is solely responsible for insuring equipment during the hire period if desired.
11.3 Starlight Party Hire accepts no responsibility for uninsured loss, theft, or damage.
- Risk Transfer
12.1 Risk in equipment transfers to the customer upon delivery or collection.
12.2 Risk remains with the customer until equipment is returned or collected by Starlight Party Hire.
- Damage, Loss, Late Pickup, Returns, Cleaning and additional charges
By proceeding with a booking, the Customer agrees to the following:
13.1 Responsibility for Hire Items
The Customer is fully responsible for all hire items from the time of collection/delivery until return to Starlight Party Hire. All items must be returned in the same condition as received, fair wear and tear excepted.
13.2 Damage, Loss or Missing Items
Any items returned damaged, excessively worn, or not returned will incur a charge equal to the full replacement or repair cost. This includes (but is not limited to) breakage, staining, weather damage, misuse, or missing components/packaging.
13.3 Cleaning Fees
All items must be returned clean and in the condition supplied.
Failure to do so will incur a cleaning fee starting from $20, depending on the level of cleaning required.
13.4 Late Returns
Items must be returned within the agreed return time window.
Late returns will incur:
- $20 late fee for returns 15 minutes or more outside the allocated time window
- Additional hire charges if items are returned the following day or later
13.5 Pickup No-Shows / Late Arrivals
Customers must collect items within their allocated pickup window.
- Arrivals 15 minutes or more late may incur a $20 late fee
- Arrivals 30 minutes or more late may be treated as a missed pickup, incurring a $40 rebooking/rescheduling fee
13.5 Delivery Delays & Access Issues
Customers must ensure clear and safe access for delivery and collection.
If Starlight Party Hire is unable to complete delivery or collection due to:
- No one present at the address
- Restricted or unsafe access
- Incorrect delivery details
Additional fees may apply, including redelivery or reattendance fees starting from $40.
13.6 Authorisation to Charge Card
By accepting these Terms & Conditions, the Customer authorises Starlight Party Hire to charge the credit/debit card provided for any costs associated with:
- Damage or loss
- Late returns or missed pickups
- Cleaning fees
- Delivery reattendance or delays
- Any other additional charges incurred under this agreement
All charges will be reasonable and reflect actual costs incurred.
13.7 Disputes
If the Customer disputes any charge, they must notify Starlight Party Hire within 48 hours of receiving notice.
Starlight Party Hire will provide supporting evidence (including photos where applicable). Failure to raise a dispute within this timeframe may result in the charge being deemed accepted.
- Setup Refusal & Site Conditions
14.1 Starlight Party Hire may refuse setup where site conditions are unsafe or unsuitable.
14.2 No refund is payable where setup cannot proceed due to site conditions.
- Variation or Partial Fulfilment
15.1 Where site conditions prevent full fulfilment of the booking, Starlight Party Hire may provide a partial order.
15.2 Starlight Party Hire is not liable for any shortfall in equipment supplied.
15.3 Any adjustment or credit is at Starlight Party Hire’s discretion.
- Warehouse Pickup & Return (Caringbah)
16.1 Collection time: Friday 9:00am – 10:00am
16.2 Return time: Monday 9:00am – 10:00am
16.3 The Customer must attend within these time windows.
16.4 Late return may incur additional hire fees or penalties.
16.5 Equipment remains the customer’s responsibility during the entire hire period.
- Indemnity
The Customer indemnifies and holds harmless Starlight Party Hire against all claims, damages, liabilities, or losses arising from:
- use of equipment
- breach of these terms
- negligence or misuse by the customer or third parties
- Legal Costs & Recovery
The Customer is liable for all reasonable costs incurred by the Starlight Party Hire in enforcing these terms or recovering unpaid amounts, including debt collection fees, administrative costs, and legal fees on a solicitor–client basis, to the extent permitted by law. This clause survives termination of the agreement.
- Limitation of Liability
To the maximum extent permitted by law:
- Starlight Party Hire is not liable for indirect, incidental, or consequential loss
- Starlight Party Hire’s total liability is limited to the value of the hire contract
- Photographic Evidence
Starlight Party Hire may take photographic evidence of:
- Site conditions
- Equipment condition
- Setup and pack down for the purposes of documentation and dispute resolution.
- Reasonable Discretion & Good Faith
Starlight Party Hire will act reasonably and in good faith when exercising discretion under these terms, including decisions relating to refunds, credits, and enforcement.
- Customer Acknowledgement
The Customer acknowledges that prior to booking they:
- have read and understood these terms
- understand risks associated with outdoor hire (including weather and site conditions)
- accept responsibility for ensuring site suitability
- No Reliance
The Customer acknowledges they have not relied on any representation, promise, or statement not expressly contained in writing within Starlight Party Hire’s quote, invoice, or these terms.
- Entire Agreement
These Terms, together with any written quote or invoice, constitute the entire agreement between the parties and supersede all prior discussions or representations.
- Acceptance
By paying a deposit, confirming a booking, or collecting equipment, the customer is deemed to have accepted these Terms & Conditions in full.
